IN Court of Appeals sides with LCRUD against Fiedlers


INDIANAPOLIS – The Indiana Court of Appeals sided with the LaGrange County Regional Utility District in its long running battle with some Shipshewana Lake property owners.

In a memorandum dated Tuesday, the Court upheld rulings by Special Judge Randy Coffey and denied the appeals by Robert and Diane Fiedler.

The Fiedlers argued Coffey abused his judicial discretion in denying their motion to amend their answer and from raising constitutional claims at the final hearing.

The court also ruled Coffey was correct in ordering them to connect to the sewer system without ordering the utility district to compensate them for an easement on their property.

The Fiedlers also questioned Coffey’s discretion in ordering them to pay attorney fees to the utility district. But the appeals court upheld that as well.
