(HAMMOND, IN) – A former officer with the Elkhart Police Department has entered a plea agreement for beating an inmate who was handcuffed to a chair.

The U.S. District Court for Northern Indiana says that Cory Newland admitted that he understood at the time of the incident that the use of force was unlawful and unjustified. The incident happened on January 12, 2018 and was recorded on surveillance video at the Police Department.

Newland and former officer Joshua Titus are charged with striking the inmate after he spat in the officers direction.

Court officials say the plea agreement specifies that Newland should get a sentence of 15 months in jail, along with make restitution to the victim in an amount to be set by the court. Newland gave permission to the U.S. Attorney’s Office to immediately perform a credit report in order to determine his ability to satisfy any financial obligation.

Titus’ trial is scheduled to start September 19.
