(LANSING) – Charges have officially been filed against St. Joseph County Prosecutor John McDonough.

Michigan Attorney General Dana Nessel announced that the 40 year old McDonough has been charged with drunken driving and having open intoxicants in a motor vehicle. He waived his arraignment on the charges of operating a motor vehicle while under the influence of alcohol and having open intoxicants inside a motor vehicle. Nessel brought the charges against McDonough.

The charges stem from an incident May 11 in Lockport Township. The St. Joseph County Sheriff's Department was called to the 17,000 block of Lovers Lane just after 7 PM. Deputies found a black SUV parked on the north side of the road, facing east. McDonough was the lone occupant of the SUV. There was damage to the vehicle and a nearby fence.

A written waiver of arraignment was filed June 17 with the 3B District Court in Centreville. Kalamazoo County District Court Judge Vincent Westra has been appointed by the State Court Administrator to preside over the proceedings.

Operating under the influence is a 93 day misdemeanor charge while the open intoxicant charge is a 90 day misdemeanor.

A pre-trial hearing has been scheduled for July 24.
