Plea Deal Reached In Sherwood Township Crash

(COLDWATER) – A Battle Creek man has entered into a plea deal involving a crash that happened in Sherwood Township over one year ago.

Branch County Circuit Court officials say Andrew Moser plead no contest to a third offense of operating under the influence of intoxicating liquor. The Branch County Prosecutor's Office agreed to drop charges of reckless driving, operating on a suspended license and lying to a police officer. The Prosecutor also said they would offer a sentencing enhancement for being a habitual offender.

On March 14, 2019, the Branch County Sheriff's Department was called to an accident at 5:40 AM at Dunks and Division Roads. Moser called in the incident and told Branch County Central Dispatch he was a passenger in the car and was not able to get out. Moser also said the driver left the area.

Investigators determined that Moser was not trapped in the vehicle and was able to get out under his own power. Deputies also discovered that Moser had been the driver of the vehicle. He failed to yield at a T intersection, crossed Dunks Road and struck several trees before his vehicle stopped in a gully.

Moser was initially treated by Life Care Ambulance at the scene and then taken to Bronson Methodist Hospital in Kalamazoo.

His sentencing has been scheduled for June 22.
